Man urinated in front of children

A homeless man breached an anti-social behaviour order when he turned up drunk at Warwick Hospital and 
urinated in full view of 
visitors including children.

Despite having no fixed address, 35-year-old Dale Radburn, who pleaded guilty to breaching the order, had been granted bail when his case was committed to Warwick Crown Court.

And at the crown court Radburn, previously of Hatton Park, Warwick, was given a community sentence with 12 months supervision.

Lynette McClement, prosecuting, said the ASBO, which had been imposed in June last year following a previous offence, had ‘some very specific requirements.

Among them were conditions that he was not to urinate in a public place and that he was not to have open cans of alcohol in a public place.

But at four in the afternoon on June 26 a security officer at Warwick Hospital heard someone shouting and using abusive language outside.

So he went out to see what was going on, and saw 
Radburn, who he recognised.

“Rather unfortunately Mr Radburn, who appeared to be intoxicated, urinated in front of members of the public who included children”, said Miss McClement.

“It so happened there were already police officers at the hospital, and they came 
immediately they were contacted and found Mr Radburn slumped up against a wall.

“He was clearly intoxicated, and next to him was an open can of alcohol.”

Jamie Strong, defending, said that in a pre-sentence report Radburn, who he 
described as a homeless 
alcoholic, seems to deny he had been urinating.

But because of the state he was in at the time, ‘he is not in a position to challenge what the officers say’.

Imposing the community order, Judge Sylvia 
de Bertodano told Radburn: “I do so with some 
reservation because your record shows you do not have a good run with orders made in the past.”
